Florida has eliminated the use of the term “custody”. Now the law speaks in terms of a parenting plan. A parenting plan sets forth when the child(ren) is with each parent. Parenting plans may be negotiated and agreed upon by the parties. Careful thought and consideration should be given to this plan since it will govern for many years after the divorce. If the parties are unable to come to an agreement, the court will impose a parenting plan.
